Unbreakable Liberty – Terms & Conditions

1. Acceptance of These Terms

By accessing unbreakableliberty.com (the “Site”) or purchasing any product from Unbreakable Liberty LLC (“Unbreakable Liberty,” “we,” “our,” or “us”), you (“you,” “your,” or the “Customer”) agree to be bound by these Terms & Conditions (“Terms”). If you do not accept every provision, do not use the Site or place an order.

2. Eligibility & Account Responsibility

  • You must be at least 18 years old (or the legal age of majority in your jurisdiction) to purchase from us.

  • You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.

3. Product Information & Pricing

  • All prices are listed in U.S. dollars and are subject to change without notice.

  • We strive for accuracy but do not warrant that product descriptions, images, or pricing are error-free. If we discover an error, we reserve the right to correct it and cancel or adjust any affected order.

4. Orders, Payment & Fraud Prevention

  • Your order constitutes an offer; acceptance occurs only when we email a formal order confirmation.

  • We may refuse or limit quantities at our sole discretion.

  • Payment must be completed at checkout using the methods provided. We employ fraud-screening measures and may cancel any transaction we suspect is unauthorized or unlawful.

5. Shipping & Delivery

  • Risk of loss and title pass to you upon our hand-off of physical goods to the carrier.

  • Stated delivery times are estimates; carrier delays are outside our control.

  • You are responsible for any customs duties, taxes, or import fees imposed by your jurisdiction.

6. Returns & Refunds

  • Physical Goods: Returns are only accepted for items damaged on arrival and must follow our separate Returns Policy (report within 3 business days, include photo evidence, no exchanges or store credit).

  • Digital Products: All digital products are final sale, non-returnable, and non-refundable.

7. Digital Content License

Upon full payment, we grant you a non-exclusive, non-transferable, revocable license to download and use purchased digital content for personal, non-commercial purposes. You may not reproduce, distribute, resell, or publicly display any digital product without our express written consent.

8. Intellectual Property

All content on the Site—including text, graphics, logos, product images, and software—is the exclusive property of Unbreakable Liberty or its licensors and is protected by U.S. and international intellectual-property laws. Unauthorized use is strictly prohibited.

9. Acceptable Use

You agree not to:

  1. Violate any applicable law or regulation;

  2. Infringe our intellectual-property rights;

  3. Upload or transmit malicious code;

  4. Engage in data scraping, hacking, or any activity that interferes with the Site’s operation;

  5. Use the Site to disseminate unlawful, defamatory, or offensive material.

We may suspend or terminate access for any violation, without notice or liability.

10. Disclaimer of Warranties

THE SITE, PRODUCTS, AND DIGITAL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of Liability

TO THE FULLEST EXTENT ALLOWED BY LAW, UNBREAKABLE LIBERTY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, DATA, OR GOODWILL) ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PURCHASE OF PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PRODUCT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to indemnify, defend, and hold harmless Unbreakable Liberty, its owners, employees, and agents from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your (a) use of the Site or products, (b) violation of these Terms, or (c) infringement of any third-party right.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws principles. Any dispute that cannot be resolved informally shall be submitted to binding arbitration in Collier County, Florida under the rules of the American Arbitration Association. You waive any right to participate in a class action against us.

14. Modifications to Terms

We may update these Terms at any time. Revised Terms become effective upon posting to the Site, and your continued use after posting constitutes acceptance. We encourage you to review the Terms periodically.

15. Severability

If any provision is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force.

16. Entire Agreement

These Terms, together with our Returns Policy and Privacy Policy, constitute the entire agreement between you and Unbreakable Liberty regarding the Site and your purchases, superseding any prior or contemporaneous communications.
